    The B.C. Court of Appeal declared Nuchatlaht Aboriginal title over the full claim area of roughly 210 square kilometres on Nootka Island.

    The court rejected an overly site-specific test and reaffirmed a territorial approach to occupation. The decision changes legal risk and negotiation leverage in land and resource decisions within the title area.
